This User Agreement (hereinafter referred to as the Agreement) is a legally binding agreement concluded between you (the User) and Mikhail Chesnokov (as indicated below) for the use of the Application.
Please read the terms of the Agreement carefully before installing the Application on your device, connecting or using Astrocheckup through a third-party AI platform, or otherwise using the Application.
The conclusion of the Agreement on the terms set forth in it (joining the Agreement) is made by any of the following: (a) downloading the Application from the Apple App Store and using it after installation; (b) completing OAuth (or similar) authorization to connect Astrocheckup, and/or connecting, enabling, or using Astrocheckup through a third-party AI platform or large language model (LLM) application that supports the Model Context Protocol (MCP) or a similar integration (including ChatGPT, Claude, Gemini, and other compatible platforms); and/or (c) otherwise accessing or using the Application. Any such action means that the User has read and fully unconditionally accepted the conditions set forth in this Agreement, as amended, valid at the time of expressing consent to use the Application, as well as the conclusion of the Agreement by joining it.
Use of the Application is permitted only under the terms of this Agreement. If the User does not accept the terms of the Agreement in full, he has no right to use the Application and undertakes to stop using it.
1. Terms and Definitions
Account is a set of data about the User provided by the User himself, which are used by the Application for its proper operation.
Mikhail Chesnokov is the copyright holder of the Application.
User - an individual aged 14 years and over who has applied for a license to use the Application on the terms and conditions specified in this Agreement.
Application means the Astrocheckup software product made available by Mikhail Chesnokov, including the Astrocheckup mobile application distributed via the Apple App Store and Astrocheckup integrations, connectors, or plugins made available through third-party AI platforms that support the Model Context Protocol (MCP), including ChatGPT, Claude, Gemini, and other compatible platforms. The Application is created by Mikhail Chesnokov to calculate and show planetary lines for the User, based on the date and place of birth.
Tariff is the Mikhail Chesnokov remuneration for granting the User the right to use the Application, the amount of which is specified in the Application.
2. General
2.1 The Agreement defines the general conditions for using the Application, as well as the rights and obligations of the User and Mikhail Chesnokov.
2.2 The Agreement can be changed and (or) supplemented by Mikhail Chesnokov unilaterally without any special notice to the User. This Agreement is an open and public document. The User is obliged to regularly check the terms of this Agreement for changes and (or) additions. Continued use of the Application by the User after making changes and (or) additions to this Agreement means acceptance and consent of the User with all such changes and (or) additions.
2.3 None of the provisions of this Agreement grant the User the rights to use the company name, trademarks, domain names and results of intellectual activity of Mikhail Chesnokov, except for the methods expressly specified in the Agreement. All rights to the elements of the Application (including objects constituting intellectual property) belong to Mikhail Chesnokov and cannot be used in a way other than specified in this Agreement.
3. Acceptance of the Agreement
3.1 The Agreement is considered concluded from the moment the User expresses consent by installing and using the mobile Application, and/or by completing OAuth (or similar) authorization to connect Astrocheckup, and/or by connecting, enabling, or using Astrocheckup through a third-party AI platform / LLM via MCP or a similar integration, and/or by otherwise accessing or using the Application.
3.2 When expressing consent by the User as indicated above, the User agrees to the terms of the Agreement, accepts them completely and unconditionally, considers himself bound by the terms of the Agreement.

3.4 By entering into this agreement, the User confirms that he complies with the full requirements of the legislation of Georgia, this Agreement, as well as the requirements of the legislation of the country of his citizenship and has the right to independently act as a party to this agreement.
3.5 In the event that you have not reached the age of full legal capacity, including, but not limited to: you have not reached the age required to enter into legally binding agreements, you are under guardianship or guardianship due to restrictive measures taken by the competent authority, as well as in any other possible cases when the conclusion of the Agreement must be carried out by your legal representative. By using the Application, you acknowledge that your legal representative has read and accepted this Agreement.
4. Subject of the Agreement
4.1 Mikhail Chesnokov grants the User the right to use (a simple (non-exclusive) license) the Application within its functionality by reproducing the Application on the User's device, solely for the User's own use without the right to sublicense to third parties.
4.2 Mikhail Chesnokov grants the User the right to use the Application without restriction on the territory in the manner and under the conditions provided for by the legislation of Georgia and this Agreement.
4.3 The right to use the Application is considered granted to the User, and Mikhail Chesnokov's obligations to grant the right to use the Application are fulfilled after the Application is installed on the User's device 4.4 The term for granting a license is determined by the type of subscription purchased by the User.
5. EXCLUSIVE RIGHTS
5.1 The Application is the result of the intellectual activity of Mikhail Chesnokov. Exclusive rights to the Application belong to Mikhail Chesnokov and are protected by the legislation of Georgia.
5.2 Application operation algorithms and its source codes (including their parts) are a trade secret of Mikhail Chesnokov. Any use of them or use of the Application in violation of the terms of this Agreement is considered a violation of the rights of Mikhail Chesnokov and is a sufficient reason to deprive the User of the rights granted under this Agreement.
5.3 This Agreement does not grant the User the right of ownership of the Application and its components, but only the right to use the Application and its components in accordance with the conditions specified in this Agreement.
5.4 The User is not entitled to copy, distribute the Application and its components in any form, including in the form of source code, in any other way, including leasing, gratuitous use, or rental.
5.5 The User is not entitled to use the Application in any way if such use is contrary to this Agreement or leads to a violation of this Agreement and the legislation of Georgia.
5.6 Liability for copyright infringement arises in accordance with the legislation of Georgia.
6. USING THE APPLICATION
6.1 For the correct use of the Application, the User's device on which the Application is installed must meet the minimum requirements, which are: iOS 10 or 4.3 Jelly Bean operating system.
6.2 Use of the Application is permitted only for personal non-commercial use. This right extends to one individual User under the terms of a personal, non-territorially limited, revocable, non-transferable and non-exclusive license to access and use the Application for personal non-commercial purposes in accordance with the terms of this Agreement.
6.3 The User has the right to use the Application without payment of remuneration within the license for evaluation (trial version) within 3 days from the start of the trial period. The trial version, at the discretion of Mikhail Chesnokov, may contain limited functionality and may not provide the opportunity to use all the features of the Application.
6.4 Further use of the Application is possible only if you purchase a subscription to the Application.
6.5 The User chooses whether to purchase a subscription to the Application and which subscription to the Application to purchase.
6.6 The choice of the respective subscription is confirmed by the User by paying the cost of the respective subscription.
6.7 By using the Application, you agree not to use it for any purpose not permitted by this Agreement. You are responsible for all your activity on the Application and you must comply with all local, state, national and international laws and regulations and any applicable regulations.
7. Use through AI Platforms and MCP
7.1 Astrocheckup may be available through third-party AI platforms and applications that support the Model Context Protocol (MCP), including ChatGPT and other compatible AI assistants.
7.2 When you use Astrocheckup through such a platform, information necessary to provide the requested service may be transmitted from the platform to Astrocheckup and processed in accordance with these Terms and our Privacy Policy.
7.3 Your use of the third-party AI platform is also subject to the terms and policies of that platform. Astrocheckup does not control and is not responsible for the operation, availability, security, or policies of third-party AI platforms.
8. PAYMENTS
8.1 The Application may offer paid subscriptions. Information about subscription plans, pricing, and duration is shown in the relevant purchase interface before you confirm payment. Available payment channels may include: (a) in-app purchases through the Apple App Store for the mobile application; and (b) purchases through a web checkout (including for Astrocheckup MCP / web interfaces) processed by Paddle or another payment provider we designate.
8.2 App Store purchases. Where you subscribe through the Apple App Store, fees are charged to your App Store account at confirmation of purchase at the prices shown for the selected plan. Billing, renewal, cancellation, and refunds for such purchases are handled by Apple in accordance with App Store terms and policies. Mikhail Chesnokov relies on the App Store payment infrastructure and does not independently process those payments or issue refunds for App Store purchases.
8.3 Web / MCP purchases (Paddle). Where you subscribe through a web checkout for Astrocheckup MCP or related web interfaces, payment is processed by Paddle.com Market Limited (or its affiliates, "Paddle") as merchant of record, unless another provider is expressly indicated at checkout. By completing such a purchase, you also agree to Paddle's applicable buyer terms and privacy notice. Paddle (or the designated provider) handles payment processing, invoicing, applicable taxes where required, renewals, cancellations through its customer tools, and refund requests according to its policies and applicable law. Mikhail Chesnokov does not store your full payment card details for Paddle checkouts.
8.4 Auto-renewal. By purchasing a subscription, you agree that it may renew automatically for the same plan and period at the then-applicable price unless you cancel before renewal in the manner required for the channel you used (App Store account settings, Paddle customer portal / cancellation tools, or another method we or the payment provider provide). Renewal timing and notice rules may follow the policies of the relevant store or payment provider (for App Store subscriptions, renewal charges are typically taken within 24 hours before the end of the period, and auto-renew must usually be turned off at least 24 hours before the end of the period).
8.5 Cancellation. To stop future charges, cancel through the same channel used for purchase before the end of any free trial or current paid period. Deleting the mobile app, disconnecting an AI platform / MCP connection, or deleting your Astrocheckup account does not by itself cancel a subscription.
8.6 Unless required by applicable law or the refund policy of the relevant payment provider, fees already paid for the current subscription period are generally non-refundable, and you may continue to use the paid features until the end of that period after cancellation of auto-renewal.
8.7 Refunds, if any, are handled by the payment channel through which you purchased (Apple for App Store purchases; Paddle or the designated provider for web / MCP purchases), according to that channel's policies and applicable law. Further details are set out in our Refund Policy.
8.8 Where the purchase interface allows plan changes, you may change subscription type subject to the rules of the relevant payment channel. Early upgrades or extensions, if offered, will be applied as described at the time of change.
9. Personal Data
9.1 For the correct use of the Application, the User may be required to provide data on his date, time and place of birth.
9.2 Mikhail Chesnokov or the Application does not collect or process special categories of personal data relating to racial or ethnic origin, political opinions, religious or philosophical beliefs or trade union membership, as well as genetic data, biometric data in order to uniquely identify users of the Application, data about health or data relating to the User's sexual life or sexual orientation.
9.3 By using the Application, the User consents to the collection, processing, storage and use of personal data provided by them, including the transfer of their data to another country.

10. Limitation of Liability
10.1 Mikhail Chesnokov is not responsible for the violation of this Agreement by the User and reserves the right, at its discretion, as well as upon receipt of information from other Users or third parties about the violation by the User of this Agreement, to change (moderate) and (or) delete any published User information that violates the prohibitions established by this Agreement, suspend, restrict or terminate the User's access to the Application at any time for any reason without explanation, with or without prior notice, without being responsible for any harm that may be caused to the User by such actions.
10.2 Mikhail Chesnokov is not responsible for the User's use of the Application or for the consequences of decisions made by the User when using the Application. The user confirms that he is fully aware of the risk of making decisions and is solely responsible for making them and taking any actions.
10.3 You expressly understand and agree that, to the extent permitted by applicable law, your use of the application is at your sole risk and the services are provided on an "as is" and "as available" basis, with all faults.
10.4 Mikhail Chesnokov, his employees, agents, representatives, suppliers, partners and content providers do not warrant: (a) that the Application will be secure or available at any particular time or in any region; (b) that any defects or errors will be corrected; (c) that any content or software available in or through the Application is free of viruses or other harmful components; (d) that the results of using the Application will meet your expectations, requirements; Your use of the Application is solely at your own risk; (e) the accuracy, reliability or completeness of the content, text, images, software, graphics or messages provided through the Application.
10.5 In no event shall Mikhail Chesnokov, his officers, directors, agents, subsidiaries, employees, advertisers and data providers be liable for any indirect, special, incidental or exemplary damages (including but not limited to lost profits, loss profit or loss of data), whether in civil action, tort (including but not limited to negligence), company equity or otherwise, arising out of the use of the Application or in any way related to the use of the Application.
11. Limitations of Use
11.1 The user is not entitled to perform actions that may result in:
11.1.1 Disrupting the Application or limiting other Users' ability to use the Application;
11.1.2 Unauthorized access to the Application, as well as information, computing and network resources of Mikhail Chesnokov;
11.1.3 Causing or threatening to cause damage to third parties, including by posting information and links to network resources, the content of which is contrary to the legislation of Georgia
11.2 The User has no right to modify the Application, design and appearance.
11.3 The User has no right to use the Application in other ways than those specified in this Agreement, as well as copy, sell and resell it or access to it.
12. Validity of this Agreement
12.1 This Agreement enters into force for the User from the moment of its accession to it and is valid for an indefinite period.
12.2 This Agreement applies to all updates to the Application provided to the User, unless when updating the Application it is proposed to read and accept the new Agreement or additions to this Agreement.
12.3 Mikhail Chesnokov has the right to change the terms of this Agreement unilaterally by posting the modified text on the Internet on the page: https://astrocheckup.app/legal/terms
12.4 If, for any reason, one or more provisions of this Agreement are duly held invalid or unenforceable, this shall not affect the validity or enforceability of the remaining provisions of this Agreement.
12.5 In the event of any disputes or disagreements related to the execution of this Agreement, the User and Mikhail Chesnokov will make every effort to resolve them through negotiations. In the event that disputes are not resolved through negotiations, disputes shall be resolved in the manner prescribed by the legislation of Georgia, at the location of the Mikhail Chesnokov, unless a different procedure for determining the applicable law and (or) the place of consideration of the dispute is not provided for by the legislation of Georgia.
12.6 Mikhail Chesnokov has the right to unilaterally terminate this Agreement in case of violation by the User of the terms of this Agreement on the use of the Application.
12.7 Upon termination of this Agreement by any party and for any reason, the User is obliged to completely stop using the Application.

13.3 Mikhail Chesnokov does not operate in the field of gambling, casino activities, lotteries, promotional games and any other professional activities that require licensing or other legal requirements.
